A House Bill is being presented to the State Legislature to evict Occupy Nashville and all other Occupy encampments across the state of Tennessee.

HOUSE BILL 2638
By Watson
AN ACT to amend Tennessee Code Annotated, Title 4;
Title 12; Title 29; Title 39 and Title 40, relative to
use of publically-owned property.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:
SECTION 1. Tennessee Code Annotated, Title 39, Chapter 17, Part 3, is amended by adding the following as a new section thereto: 39-17-318.

(a) A person shall not maintain living quarters on publically-owned
property that is not designated or permitted for residential use.
(b) A person’s use or assembly upon publically-owned property shall not
pose a health hazard or threat to the safety or welfare of another person using,
assembling upon, or employed to work upon that property.
(c) A violation of subsection (a) or (b) is a Class C misdemeanor.
(d) In addition to any other penalty imposed by law, a person in violation
of this section shall be:
(1) Subject to temporary or permanent removal from the property
by the appropriate law enforcement agency; and
(2) Liable for any damage or depletion in value to the property as
a result of the person’s use or assembly.

SECTION 2. This act shall take effect upon becoming a law, the public welfare requiring it.

Occupy Nashville is asking for help in opposing this pending legislation that would put an end to any and all occupy encampments in the state of Tennessee.
